1. Introduction & Acceptance of Terms
Welcome to Dandelyons Studios, LLC (“Company,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website, products, and services, including but not limited to oral history recordings, family storytelling projects, and historical documentation (“Services”). By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Services.
2. Services Provided & Nature of Engagement
Our Services include oral history collection, digital archiving, and storytelling consultation for individuals, families, and organizations.
Not Therapy or Legal Advice: Our Services are not a substitute for therapy, legal counsel, or estate planning. Any insights gained should be considered personal reflections, not professional guidance.
3. Intellectual Property (IP) & Licensing
A. Ownership of Materials
Unless otherwise agreed in writing, we retain all intellectual property rights over any materials we create, including but not limited to:
Interview recordings (audio/video)
Transcripts and written reflections
Digital archives and curated historical documentation
Clients receive a non-exclusive, personal-use license to access and share their specific content within their families.
B. Client-Generated Content
If you provide photos, documents, or materials, you grant us a non-exclusive, royalty-free license to incorporate them into the final work.
You confirm that you own or have permission to share any third-party content provided.
C. Limited Rights for Promotional Use
By engaging our Services, you grant us limited rights to use anonymized excerpts of interviews and project content for educational, promotional, or archival purposes.
Opt-Out: You may request in writing that your materials not be used for public-facing content.
4. Privacy, Data Stewardship & Compliance
A. Collection & Storage of Data
We collect and securely store personal data, including names, contact details, session recordings, and transcripts.
Your information is protected using industry-standard encryption and security measures.
B. Compliance with Global Privacy Laws
If you are located in the EU/UK, we comply with GDPR regulations, including the right to access and delete your data.
If you are a California resident, you have rights under the CCPA regarding data transparency and deletion.
C. Data Retention & Requests for Deletion
We retain recorded materials for a minimum of five (5) years unless a deletion request is submitted in writing.
Upon request, we can provide editable, downloadable copies of your oral history materials before deletion.
5. Social Media, Likeness, & Publicity Rights
A. Use of Name, Image, & Likeness
By engaging in our Services, you grant us permission to use your first name and audio/video likeness for internal reference and promotional materials.
If we wish to use your full name or feature your story publicly, we will obtain written consent.
B. Opting Out of Publicity
You may opt out of any public-facing use of your image or content at any time in writing.
6. Limitation of Liability & Disclaimers
No Guarantees: We do not guarantee specific results or outcomes.
No Responsibility for Third-Party Misuse: If content is shared outside of its intended audience, we are not responsible for unauthorized use.
Force Majeure: We are not liable for unforeseen events that prevent us from fulfilling our Services, including natural disasters, cyberattacks, or legal restrictions.
7. Dispute Resolution & Governing Law
Dispute Resolution: In the event of a dispute, both parties agree to mediation before pursuing legal action.
Jurisdiction: These Terms are governed by the laws of New York, NY and New Jersey.
